Family releases video that shows naked Rio Linda man shot, killed by deputy

RIO LINDA, Calif., April 3, 2024 – Video footage of the fatal shooting of Christopher Gilmore by a Sacramento Sheriff’s Department deputy the morning of March 23 shows that the suicidal man presented no threat to the responding deputies, attorneys for Gilmore’s family said Wednesday.

The 60-second home security camera video captures deputies positioned on the driveway before Gilmore emerges, naked and bleeding, and stumbles down the driveway alongside a parked pickup truck.

His roommates called 911 after Gilmore, who suffered from mental health issues, locked himself in a bathroom, cutting himself and threatening suicide.

The video shows Gilmore, 38, emerging from the home as one deputy announces, “He has a knife.” Another deputy fires five non-lethal rounds at Gilmore as he walks toward the street. His sister was standing across the street.

“Christopher came out of the house because he heard me calling him from across the street,” said Bobbie Gilmore, his older sister. “He was walking to me and never approached any of the deputies.”

Suddenly, a deputy fires three shots at Gilmore as he reaches the sidewalk. Gilmore collapses and rolls into the street. As he lay still and dying, Bobbie Gilmore begs deputies to go help him. They do not promptly render any first aid despite Gilmore lying on the ground helplessly as a deputy kicks away a small disposable razor which was a few feet away from him. There was no knife.

Although Gilmore was holding the little razor he’d used to cut himself with, he never brandished it at the police and never approached the deputies, who stood several feet away from the clearly distraught man, said Los Angeles civil rights attorney V. James DeSimone, who is representing some of Gilmore’s family, including two of his four children.

“Law enforcement was called to preserve this man’s life,” DeSimone said. “Instead they abruptly ended it when Christopher Gilmore clearly posed no threat to any officer or other person.”

The family seeks a full investigation, said Sacramento litigator Daniel Del Rio, who also represents the family members.

“This heartbreaking footage of Christopher Gilmore’s final moments reveals a deeply troubling lack of compassion and a failure to adhere to training protocols designed to de-escalate and protect those in mental health crises,” Del Rio said.

DeSimone, of V. James DeSimone Law, and Del Rio, of Del Rio & Caraway, represent Bobbi Gilmore and two of his minor children, a daughter, age 11, and a son, age 14.
