While about half the states in the country vow they will not follow the new rule V. James DeSimone explains that it really is just common sense legislation. “Why should universities or colleges be able to discriminate against people based on their sexual orientation or gender identity?” And this codifies the law protecting these people against discrimination.
Sacramento Fox 40 anchor Sonseeahray Tonsall interviews V. James DeSimone and Bobbie Gilmore, the sister of Chris Gilmore. Chris Gilmore lived with mental illness, and was fatally shot by a Sacramento County Sheriff's Office deputy. Gilmore was naked and bleeding from trying to hurt himself, and never threatened or made a move towards the deputy before he was shot.
Christopher Gilmore, 38, was reportedly suffering from a mental health crisis and was shot by deputies outside of his home in Rio Linda on March 23. Gilmore's sister, Bobbie, called 911 after she said her brother was cutting himself inside a bathroom when deputies arrived. In the 23-minute body camera video explaining the situation on social media, Gilmore can be seen holding a knife. V. James DeSimone, representing Gilmore's family, says the use of force was not justified and added that despite holding a knife, Gilmore did not pose a threat to deputies. "The fact that he was holding a knife does not justify the use of deadly force because he was not using that knife in any threatening manner as he was exiting down that driveway," DeSimone said.

Civil rights attorney V. James DeSimone and Karen Sutherland discuss the need for police to follow their training when making arrests, and to not leave handcuffed people in a prone position. Since 1995 the Department of Justice directs arresting officers to roll arrestees from a prone position onto their sides, in what is known as a recovery position. This prevents deaths from positional asphyxiation, which Shayne Sutherland suffered during his 2020 arrest by Stockton Police. Sutherland was having a mental health episode, was unarmed, and had been subdued and cuffed while officers lay on his back, using batons, ordering him to "stop fighting" while he struggled to breath and told the officers he didn't want to die.
