V. James DeSimone named one of 2023’s Top Plaintiffs Lawyers by the Daily Journal

MARINA DEL REY, CALIF., Nov. 20, 2023 – V. James DeSimone has been named one of California’s top plaintiffs attorneys by the Daily Journal.

An accompanying story focused on DeSimone’s recent activities inside and outside the courtroom, including earlier this year when he argued before the Ninth Circuit Court of Appeals in a lawsuit involving LAPD officers responsible for the death of Daniel Rivera.

DeSimone successfully contended that a district court’s decision to afford four LAPD officers qualified immunity should be overturned because their behavior was a clear breach of established law, and in violation of the United States Constitution.

“Qualified immunity is one of the greatest challenges in seeking justice for men and women who die or suffer grievously at the hands of police officers in wrongful death or excessive force cases,” DeSimone told the Daily Journal. “Perhaps officers believe this will always shield them from consequences when they use combat-style methods on people who often are suffering nonviolent mental health crises or who have already surrendered.”

DeSimone’s work on behalf of the family of a deceased woman targeted and discriminated against by her employer after she was diagnosed with cancer was also noted. DeSimone secured $500,000 in punitive damages for her family, an amount that was 30 times the economic damages she suffered. The verdict was upheld on appeal.

Outside the courtroom, DeSimone brings his legal acumen to national audiences where he provides expert commentary to media outlets that include the Los Angeles Times, Salon, Newsweek, Court TV and Fox News.

He’s also a presenter or panelist at various legal conferences, where he speaks on winning trial techniques, litigating civil rights cases, employment disability cases, and other aspects of civil rights and employment law.
